Our Terms and Conditions

 

Charges

Gelato packages provided by The Mobile Gelato Cart are quoted and charged inclusive of:

(a)  Set up and pack up

(b)  Travel costs include delivery within the Perth Metropolitan Area and up to a 50km radius.

(c)  Deliveries outside of this 50km area may be subject to additional charges based on travel time and distance.

(d)  Staff service

(e)  Wafer cones, cups, spoons and napkins

(f)   Gelato.

 

Confirmation of Booking

A booking will be deemed confirmed upon receipt of a deposit equal to 25% of the expected final balance.

 

Payment

 

Terms of Payment

The Customer must pay The Mobile Gelato Cart the fees as set out below:

(a)  Full payment of the deposit is required to confirm the booking. This amount will be applied against the final tax invoice as part consideration.

(b)  The Final Amount payable minus the deposit is payable upon receipt of account. The Final payment must be received 30 days prior to the event.

 

Non Payment

If the Customer does not fulfil the payment obligations, The Mobile Gelato Cart has the right to terminate the booking in which case the deposit will not be refunded.

 

Cancellation

If the Customer cancels the booking prior to the date, the Customer acknowledges this will cause a reasonably foreseeable loss to The Mobile Gelato Cart, and the Customer agrees that:

(a)  They will forfeit the deposit.

(b)  The deposit retained by The Mobile Gelato Cart is to compensate The Mobile Gelato Cart for its reasonably foreseeable loss in the likely event that they will be unable to further book that date.

 

Postponement

In the event that the Customer wishes to reschedule the booking for any reason, including due to any imposed restriction resulting from the COVID-19 Pandemic or any other force majeure event, any rescheduling of the booking will only be effected once confirmed in writing by The Mobile Gelato Cart and subject to the following provisions:

(a)  If the Customer wishes to reschedule the date of the booking, The Mobile Gelato Cart will make all reasonable attempts to accommodate the new date, however is under no obligation to provide service on the new date. This is at the sole discretion of The Mobile Gelato Cart.

(b)  Any rescheduled date must be within twelve (12) months of the original booked date.

(c)  Any rescheduled booking may be adjusted and charged per the prices in effect at the time of rescheduled booking.

(d)  The Customer has the benefit of this clause only once.

 

 

Liability

The Mobile Gelato Cart is not liable or responsible to the Customer or any servants, officers, contractors, guests, members, patrons, invitees or any other persons associated with them for any loss of life, personal injury or damage to or loss of property which may be suffered at any venues except where such injury, loss or damage arises by reason of an act or omission of The Mobile Gelato Cart or its employees, agents or subcontractors.

 

Marketing

The Mobile Gelato Cart actively markets its services in all forms of media including print, web and internet based social networks. Given the prolific use of these networks, The Mobile Gelato Cart reserves the right to use images captured at events for which they are catering gelato unless individuals specifically deny permission.

By accessing and or using this website you agree to comply with the Terms and Conditions of The Mobile Gelato Cart. Our Terms and Conditions are subject to modification to respond to our business needs and we endeavour to amend and publish such changes as soon as practicable.
